Varsity Fitness PTY LTD (ABN 88 656 990 448) (referred to as “Varsity Fit”, “we”, “us” or “our”) is committed to protecting your privacy and handling your personal information responsibly. This Privacy Policy describes how we collect, use, store, disclose and protect your personal information when you use our website (www.varsityfit.com.au), our mobile application (the “Varsity Fit App”), and any related services, tools, resources and platforms (collectively, the “Platform”).

We are an Australian health and fitness service provider. As such, we take our obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) seriously. Where applicable, this Privacy Policy also addresses requirements under the Notifiable Data Breaches (NDB) scheme.

By accessing or using our Platform, you acknowledge that you have read, understood and agree to the collection, use and disclosure of your personal information as described in this Privacy Policy. If you do not agree, please do not use our Platform.

Varsity Fit provides strength and conditioning, nutrition coaching, corporate wellness programs, health and performance testing, educational resources, and digital fitness tools. Our services are delivered through in-person sessions, our website, and our mobile application.

3. What Personal Information We Collect

  • Workplace/organisation information: employer details, job title, workplace wellness program participation
  • Communications: messages, feedback, support requests and other correspondence

3.2 Information Collected Automatically

  • Device information: device type, operating system, unique device identifiers, browser type
  • Usage information: pages visited, features used, time spent on Platform, clickstream data
  • Log data: IP address, access times, referring URLs, error logs
  • Location data: general geographic location based on IP address (we do not collect precise GPS data unless you provide consent)
  • Cookies and similar technologies: see Section 8 (Cookies and Tracking Technologies) below
  • Anti-spam and security technologies: We use Google reCAPTCHA on certain forms to protect our Platform from spam and automated abuse. reCAPTCHA may collect and transmit hardware and software information (such as device data, application data, and interaction patterns) to Google for analysis. The use of reCAPTCHA is subject to Google’s Privacy Policy and Terms of Service.

3.3 Information from Third Parties

  • Wearable device and fitness tracker data if you choose to connect a compatible device
  • Corporate wellness program administrators who enrol employees in our services

Some of the information we collect may be classified as “sensitive information” under the Privacy Act, including health information. We will only collect sensitive information with your consent and where it is reasonably necessary for the provision of our services (for example, to design safe and effective training or nutrition programs).

We use your personal information for the following purposes:

  • To provide, personalise and improve our services, including tailored training programs, nutrition plans and health assessments
  • To create and manage your account on our Platform
  • To process payments and manage subscriptions

  • To deliver corporate wellness programs and provide progress reporting to participating organisations (in de-identified or aggregated form unless you consent otherwise)

5. How We Share Your Personal Information

We will not sell your personal information to third parties. We may share your personal information in the following circumstances:

  • Service providers: We may share information with trusted third-party providers who assist us in operating our Platform and delivering our services, including payment processors, cloud hosting providers, email service providers, and analytics tools.   • Corporate wellness clients: Where you participate in a corporate wellness program, we may share de-identified or aggregated data with your employer or organisation for program reporting purposes. Individual health data will only be shared with your explicit consent.
  • Professional referrals: With your consent, we may share relevant information with other health professionals (such as doctors, physiotherapists or dietitians) involved in your care.

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification and disclosure. Our security measures include:

8. Cookies and Tracking Technologies

This data is processed by Google in accordance with their Privacy Policy. No reCAPTCHA data is stored by Varsity Fit; it is processed solely by Google for the purpose of spam prevention.

You can manage your cookie preferences through your browser settings. Disabling certain cookies may affect the functionality of our Platform.

8.1 Google Analytics 4 (GA4)

We use Google Analytics 4 (GA4), a web analytics service provided by Google LLC (“Google”). GA4 helps us understand how visitors interact with our website and free calculator tools so we can improve them over time.

What GA4 collects on our behalf:

  • Pages visited and navigation patterns
  • Which calculators are opened, interacted with, and completed
  • Form engagement events (e.g. whether a form was submitted successfully)
  • General device and browser type, and approximate geographic region based on IP address

How we protect your data in GA4: All numeric values entered into our calculators (such as body measurements or performance results) are converted to predefined ranges (for example, “61–80 kg”) before any data is transmitted to Google. Raw input values are never sent. No names, email addresses, phone numbers, or other personally identifying information are included in analytics data.

Analytics notice: When you visit our website, an analytics notice is displayed to inform you of our use of GA4.

Opting out: You can opt out of Google Analytics tracking across all websites by installing the Google Analytics Opt-out Browser Add-on. You may also disable analytics cookies through your browser settings.

Data storage: Analytics data collected by GA4 is transmitted to and stored on Google’s servers, which may be located outside Australia. Google may use this data in accordance with its own privacy policy.

9. Your Rights

Under the Australian Privacy Principles, you have the following rights in relation to your personal information:

  • Access: You may request access to the personal information we hold about you. We will respond to your request within a reasonable timeframe.
  • Correction: You may request that we correct any personal information that is inaccurate, incomplete, out of date or misleading.
  • Anonymity and pseudonymity: Where practicable, you have the option of dealing with us without identifying yourself or by using a pseudonym. However, this may limit our ability to provide certain services to you.
  • Opt-out of marketing: You may opt out of receiving marketing communications at any time by using the unsubscribe link in our emails or by contacting us directly. Please note that you may still receive transactional or service-related communications.
  • Deletion: You may request that we delete your account and associated personal information. Some information may be retained where required by law or for legitimate business purposes.

10. Children’s Privacy

Our Platform is not directed at children under the age of 16. We do not knowingly collect personal information from children under 16 without parental or guardian consent. Our Platform may contain links to third-party websites, applications or services that are not owned or controlled by Varsity Fit. You may opt out of receiving marketing communications at any time by clicking the unsubscribe link in our emails, adjusting your account notification preferences, or contacting us directly. We will process your opt-out request promptly and without charge.

13. Notifiable Data Breaches

In the event of a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will comply with the Notifiable Data Breaches scheme under the Privacy Act 1988. This includes notifying the Office of the Australian Information Commissioner (OAIC) and affected individuals as required.

If you believe that we have breached the Australian Privacy Principles or mishandled your personal information, you have the right to lodge a complaint with us. Please contact us using the details in Section 2 and we will investigate and respond to your complaint within 30 days.

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements. We will post the updated Privacy Policy on our Platform and update the “Last Updated” date at the top of this document. Where changes are significant, we will notify you by email or through a prominent notice on our Platform.
